Contempt of Court issue raised in Fonseka's case

(May 19, Colombo, Sri Lanka Guardian) The Senior State Counsel appearing on behalf of former Army Commander Sarath Fonseka in the ‘White Flag’ case before the High Court Trial-at-bar today informed Courts they intend bringing Contempt of Court charges against Sunday Leader Editor Frederica Jansz who has reported on matters related to the case, despite an and order not to report until the trial was concluded.

Mr. Nalin Ladduwahetti told Courts that they hope to raise the issue of charges after the Dock statement by Mr. Fonseka is completed and also after the evidence of the defence witnesses are completed.

He said that in an article which appeared in the Sunday Leader last week there were references to the on going trial, despite the Court order given earlier not to report on the case.

Meanwhile the trial was postponed until May 23 as Mr. Fonseka’s doctor has informed that he needs further rest.

Mr. Fonseka is accused with having stated in an interview with the newspaper that the Defence Secretary had ordered not to spare any of the LTTE cadres surrendering even if they were coming with white flags during the last stages of the military assault on the guerrillas in May, 2009.

He is charged for making a false statement to the Sunday Leader, arousing communal feelings and arousing anti-government feelings among the public and creating disputes among them.

The Trial-at-Bar consists of Judges Deepali Wijesundara (President), W.T. M. P.B. Warawewa and M.S Razeen .
