Court of Appeal quashes PSC report and findings on CJ

( January 7, 2013, Colombo, Sri Lanka Guardian) In a dramatic and decisive move the Court of Appeal today (Jan 7) quashed the report and findings of the Parliamentary Select Committee (PSC) which had probed the impeachment motion again Chief Justice Shirani Bandaranayake and found her guilty on three of the 14 charges against her.

The Court of Appeal verdict came on a petition filed by the Chief Justice who sought a writ from the court to qaush the findings of the PSC. Today’s verdict by the Court of Appeal came after the Supreme Courts rule last week that the whole process of impeaching judges under Standing Order 78A of Parliament was unconstitutional and therefore null and void.

President Mahinda Rajapakse and other government leaders have vowed they will go ahead with the impeachment but independent legal observers and analysts said Sri Lanka was facing its gravest constitutional and legal crisis since independence in 1948.

The analysts warned that if the government went ahead with the impeachment motion it would undermine the independence of the judiciary and lead to a total breakdown of the rule of law
